Certificate of Need Renewal

A Certificate of Need is normally valid for up to three years and may be renewed if the project has not been completed. For the first four years, renewals are based on the degree to which the holder of a Certificate has made substantial progress on the project. The Certificate holder must adhere to the schedule approved by the SHPDA or be able to justify missing the schedule. Certificate of Need holders normally must submit quarterly progress reports to the SHPDA. The holder must also comply with any conditions that may have been placed on the Certificate of Need.

After four renewals, the applicant will have to submit a new application for the fifth renewal. Renewals are normally reviewed only by the SHPDA staff and Director. If the SHPDA determines that "substantial progress" has not been made, a 90-day administrative extension will be issued. During this 90-day period, the Certificate holder will be given the opportunity to counter the SHPDA's finding of insufficient progress and correct deficiencies that may have resulted in the finding. The SHPDA may take action, including the conduct of a public hearing, to withdraw the Certificate of Need.
